The Council of Ministers approved by Royal Decree-law urgent measures for the housing sector. In regards to rentals, we come across these novelties:
Contracts for more time
Rental contracts will have a duration of five years, except in case the landlord is a legal entity, then the duration will be of a mínimum duration of seven years. Extending, thus, the mínimum term established so far.
Contract extensión
At the expiration date of the contract or, when applicable, subsequent extensions, the tacit extension period, which will be 3 years, varies, except in the case of long-term rentals.
Limited deposit
The landlord cannot demand a deposit, which is of an amount superior than 2 months of the monthly rental rent, to cover the additional guarantees.
These regulatory changes shall not be applied retroactively.
